After the success of our global ITX health industry convention last year, we will once again be discussing current developments, innovations and challenges that could have a major impact on the pharmaceutical, healthcare and life science industries from an indirect tax perspective.
Speakers from various territories will be on hand to provide you with their specialist expertise and country-specific perspectives. The topics we’ll be covering will include the following:
• Compassionate use, managed access, named-patient programmes: pharmaceutical companies may provide medicinal products free of charge for many reasons. We’ll explore potential VAT treatments and how additional VAT costs may arise.
• Swiss VAT law: some major changes are planned in Swiss VAT law for 2024/2025, including for compassionate use treatment. We’ll visualise these changes and explain why you need to start preparing now.
• Update on applying the ECJ Boehringer Ingelheim ruling: the VAT treatment of rebates as paid across the EU and Europe at large continues to be challenged by some tax authorities, and guidance is continuing to evolve. We’ll provide an update on the appeals, using the UK courts as an example.
• Update on medtech payback in Italy: under a recent Italian decree, so-called medtech payback payments may qualify as rebates for VAT purposes. We’ll provide an update on the main provisions, focusing on VAT recovery (procedure, timing and necessary documentation) and on the major outstanding issues that you need to manage.
